Terms of Service
These terms cover how you and Atlais Shop work together. Please read them — especially the parts about spending authorizations, refunds, and dispute resolution.
1. Acceptance of these terms
By using Atlais Shop ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service. You must be at least 18 years old and legally capable of entering contracts in your jurisdiction to use Atlais Shop.
2. What Atlais Shop does
Atlais Shop is a personal AI concierge that acts on your behalf, with your explicit authorization, to handle purchases, research, scheduling, communication, and similar tasks. Atlais Shop is:
- A service that facilitates transactions between you and third-party merchants. Atlais is not the merchant of record for the goods and services you purchase. Your card statement shows the real merchant's name, and your purchase is governed by the merchant's own terms of sale, return policy, and warranty.
- An autonomous agent that acts based on your explicit authorizations. Before Atlais makes any purchase, you authorize a specific spending scope (maximum amount, permitted merchants, validity window). Atlais cannot and will not exceed the scope you authorized.
- A communication layer that contacts merchants, negotiates delivery details, and tracks orders on your behalf.
Atlais Shop is not a bank, not a money-transmission service, not a marketplace, not a merchant-of-record for third-party goods, not a financial advisor, and not a lawyer. Atlais does not provide financial, legal, medical, or tax advice.
3. Your account and responsibilities
You agree to:
- Provide accurate information when asked (your name, delivery address, payment details via Google Pay, etc.).
- Keep the WhatsApp account associated with Atlais Shop secure. If your WhatsApp account is compromised, contact us immediately at support@atlais.com so we can revoke any active authorizations.
- Only authorize purchases you intend to make. Atlais treats your explicit authorization as binding consent to spend up to the authorized amount with the authorized merchants during the authorized window.
- Not use Atlais Shop for illegal purposes, to defraud others, to purchase prohibited items (including controlled substances, weapons, counterfeit goods, or anything else your jurisdiction forbids), or to harm others.
4. Spending authorizations
Spending authorizations are the core of how Atlais Shop operates. When you authorize Atlais to spend money, you are granting it binding permission to execute purchases on your behalf within the limits you set. By authorizing:
- You confirm the payment method is yours and you have the authority to use it.
- You agree to the purchases Atlais makes within the authorized scope, including any taxes, shipping costs, and fees the merchant charges (provided they remain within your authorized maximum).
- You acknowledge that purchases made under a valid authorization cannot be refunded by Atlais directly — refunds must be pursued with the merchant of record, per their policy. Atlais will help coordinate refund and return processes as part of our customer support.
- You can revoke any authorization at any time by messaging Atlais. Revocation is immediate but does not cancel purchases already completed under that authorization before the revocation.
5. Payment
Atlais Shop uses Google Pay as the payment credential provider and Stripe as the gateway processor. When you authorize a purchase, Google Pay produces an encrypted payment token that is passed to the merchant's payment system. Atlais Shop never sees, stores, or transmits your card number or other raw payment details.
You are responsible for any charges made under authorizations you granted. You are also responsible for any chargebacks, disputes, or reversals filed against your payments — though we will assist in good faith to resolve legitimate disputes.
Atlais Shop does not currently charge a separate fee for service. If we introduce service fees in the future, we will notify you before applying them to your account.
6. Returns, refunds, and disputes
Atlais Shop is not the merchant of record for the products you purchase. Returns, refunds, warranty claims, and quality disputes must be handled with the merchant of record according to their policies. We will help you:
- Locate your order history and relevant details.
- Contact the merchant on your behalf to initiate a return, refund, or exchange.
- Coordinate with your card issuer if a chargeback becomes necessary.
We cannot issue refunds for purchases made through third-party merchants. We can, however, provide documentation and records to support your own refund or chargeback claims.
7. Our service availability
Atlais Shop is provided "as is" and "as available". We do not guarantee uninterrupted, error-free, or fully accurate service. Specifically:
- Atlais may make mistakes. AI agents sometimes misinterpret requests. The spending-authorization system is designed to cap the financial impact of any mistake, but we cannot guarantee perfection.
- Merchants may be unavailable, out of stock, or close before Atlais completes a task. We do our best to communicate clearly when this happens.
- WhatsApp, Google Pay, and other upstream services may have outages. We depend on them and cannot control their availability.
We strive to provide timely, accurate, and helpful service. If you believe Atlais Shop has failed you in a specific instance, please contact us so we can make it right.
8. Limitation of liability
To the maximum extent permitted by law, Atlais Shop and its owners, operators, employees, and contractors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the Service.
Our total aggregate liability to you for any claim arising from these Terms or from your use of the Service is limited to the greater of: (a) one hundred US dollars ($100), or (b) the amount you have paid Atlais Shop directly (not including purchases routed through Atlais to third-party merchants) in the twelve months preceding the claim.
Nothing in these Terms limits liability that cannot be excluded by applicable law.
9. Indemnification
You agree to defend, indemnify, and hold harmless Atlais Shop from any claims, damages, liabilities, or expenses (including reasonable attorney fees) arising from: your use of the Service in violation of these Terms; your violation of applicable law; your violation of any third-party right (including intellectual property and privacy rights); or inaccurate information you provided us.
10. Dispute resolution and arbitration
In the event of any dispute arising from these Terms or from your use of the Service, we agree to first attempt in good faith to resolve the dispute informally by contacting support@atlais.com. If we cannot resolve the dispute within 60 days, either party may demand binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in English, on a documents- only basis unless either party requests an in-person or telephonic hearing.
You and Atlais Shop waive any right to a trial by jury and to participate in a class action lawsuit. This arbitration clause does not prevent either party from seeking injunctive relief in a court of competent jurisdiction to protect intellectual property rights or prevent imminent irreparable harm.
11. Termination
You may stop using Atlais Shop at any time. To permanently delete your account and all associated data, email support@atlais.com with the request.
We may suspend or terminate your access to Atlais Shop if you violate these Terms, abuse the service, attempt to harm other users, or if required by law. We will make reasonable efforts to notify you before termination unless doing so would be illegal or harmful.
12. Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws principles. Any court proceedings (as permitted by Section 10) must be brought in the state or federal courts located in Wyoming.
13. Changes to these terms
We may update these Terms from time to time. The "Effective date" at the top reflects the most recent update. If we make material changes, we will notify you by email or WhatsApp at least 14 days before the changes take effect. Continued use of Atlais Shop after the effective date constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you may stop using the Service.
